Application Terms of Use

evowera Application Terms of Use was updated on May 10, 2022.

Thank you for your support for evowera. The evowera mobile application (hereinafter referred to as the “application”) is provided to you by Shenzhen EVOWERA Technology Co.,Ltd. (hereinafter referred to as “evowera”), in the hope of giving you a healthier and more enjoyable personal care experience.

To use the application, you must understand and agree to the following information about the application and device.

1. During your use of the application, the hardware device will communicate with the mobile device via Bluetooth/network. The device that can be connected to the application is the evowera planck series smart toothbrush. During the communication between the application and the device, data about your brushing power, brushing behavior, and physical condition will be used. The application helps you improve your oral care experience through cooperation with the device, and you can get the scientifically calculated suitable brushing power output and view data about brushing, oral health and device usage, and your toothbrush can automatically avoid sensitive areas.

2. When connected to the WiFi smart toothbrush, the application will get your IP address and WiFi information, and meanwhile get data such as brushing time, brushing duration, brushing pressure, brushing torque, and brushing posture from the connected device. 1) Brushing time and duration, which are obtained through the main control chip and can help calculate the required brushing time and determine whether the interval of brushing is healthy and the service life of the toothbrush head. 2) Brushing pressure, torque, and bristle swing, which are obtained through the chip of the electronic speed control and can help calculate the required suitable power output and determine the service life of the toothbrush head. 3) Brushing posture, which is obtained through the gyroscope and can help determine the precise position of the bristles in the mouth and your daily usage habits.

3.The application will provide you with the following features:

“Data”

1）Display your device usage data, which is valid for 1 year, including your brushing duration, time and frequency of use, brushing coverage, brushing strength, brushing interval, remaining service life of the toothbrush head, dental calculus profile, and menstrual health.

2）View the service life of the bristles.

3）The female menstrual cycle recording and forecasting feature specifically provided will help female users record their menstrual cycle easily.

“Device”

Select the commonly used cleaning mode.

Set the brightness of the charger’s light and the delay in turning it off.

Select and set the welcome sound when the device is powered on.

Select and set the user interface design style of the device’s screen.

Erase device data and cancel account information.

Set the sensitive area of your teeth or the area that requires gentle care, and sync the set area to the device to set an appropriate power output for the device.

Select and set your dominant hand.

Set your IP location and temperature units you are accustomed to using.

Set the working network of your smart electric toothbrush.

By connecting to the online evowera store, you can place an order online to purchase the products and services provided by evowera as well as selected third-party products.

“Me”

Set a profile picture and a nickname for your account, fill in your email address, birthday, mail address and gender, and change your password.

4.By signing up for and using the application, you agree to these Terms of Use. If you do not agree to these Terms of Use, evowera will be unable to provide you with smart services which are not associated with the device.

5.You need to download the application from the mobile application store, create your own evowera ID account, and accept the Application Terms of Use. You acknowledge that the evowera ID account created by you and the application are the only official channel for evowera to send messages to you.

6.Please follow the instructions in the manual and application to connect your evowera device with your mobile device and activate the application.

7. We prohibit anyone under 18 from registering and using an evowera application. For minors, please have a parent/guardian to perform the operation.

8. You accept and agree to all of our prohibitions and promise that the personal information you use to register is correct and true, and that the registration is performed by you instead of a minor under your guardianship. Your registration with this application represents your consent to our collection of and linking to your registered account the toothbrushing data of the minor under your guardianship. You will not claim any rights against evowera by any means, including but not limited to complaints, recoveries, claims, arbitrations, and lawsuits, as a result of your personal information being registered by the minor under your guardianship or as a result of the toothbrushing data of the minor under your guardianship being linked to the evowera application.

9.You agree to provide your personal information requested by evowera and update your information in a timely manner.

10.You have no rights in and to the application. However, evowera grants you a license to use the application for the foregoing purpose on any Apple or Android device owned or controlled by you. This license is not transferable and is only valid between you and evowera.

11.The intellectual property rights in and to all content that appears in the application, including but not limited to original designs, videos, articles, and trademarks, are owned by evowera. Without the written consent of evowera, no individuals and organizations may copy, modify, create any derivative works from, or display, publish, disseminate, or broadcast any content to any third party (including using a third-party website). evowera reserves all rights not expressly granted herein.

12.You agree not to create any derivative works or enter into any leases or borrowings based on the content in the application, reverse engineer, decompile, translate, modify, or disassemble the application, or attempt to create the source code from the object code of the application.

13.The application is provided to the users of evowera devices by evowera free of charge. The cost of the cellular data or wireless network traffic consumed during your use of the application is payable by you.

14.evowera provides a two years warranty for the product purchased by you. You can choose to activate it as instructed in the manual within three months after its manufacture date, and the warranty shall apply from the date on which your device is activated. If you choose to activate your device after the three-month period or not to activate it, the warranty shall apply from the date indicated on the receipt. If the receipt is lost, the warranty for your device shall apply from its manufacture date. Due to differences between countries, the warranty policy in some countries is governed by applicable local laws and regulations. We are committed to comply with the laws and regulations of your country or region regarding quality warranty. This warranty will not prejudice any warranty available to you as a resident of your country.

The specific quality guarantee policy is detailed in the evowera Product Quality Guarantee Agreement.

15.Although evowera is always committed to providing users with the most convenient and efficient user experience, unfortunately, we cannot guarantee that the stability, reliability, and accuracy of the application and device fully meet your requirements. We sincerely invite you to join our product improvement program and help us improve and optimize our services by sending problems and suggestions regarding your use to us.

16.We express our sincerest apologies to you if the application does not work or something unfortunate happens due to any unpredictable cause. Unfortunately, we are not liable for any damage arising therefrom to the maximum extent permitted by applicable law.

17.If evowera believes in good faith that you have violated these Terms of Use during your use of the application, evowera may suspend or terminate your right to continue to use the application, and you will no longer have the right to access the application.

18.evowera reserves the right to modify or update the application from time to time. evowera may notify you by email, text message, or telephone. However, you acknowledge and agree that evowera may not notify you of some modifications and updates, depending on the importance of such modifications and updates and evowera's control policy concerning the notification of users. If evowera notifies you of any modifications or updates by any of the means of communication described above, by making no responses or choosing to continue to use the application, you agree to such modifications or updates.

19.During your use of the application, you may use a third-party service or purchase any product provided by a third party. Please carefully read and comply with the terms that govern such third-party services or products. You agree to bear the expenses and liability arising from your use of third-party services and products.

20.Except those terms which we have called for your special attention to, these Terms of Use are governed by the laws of the People's Republic of China.
